It's been a busy month for the Tribunals and as we are in the run up to April, there's plenty of news to get our heads around too. Client's - we're building your employment law updates as we speak so stay tuned for more in the coming weeks.

This month in InView we look at updates on the Equality Act 2010, including an update to a case we reported back in January and the team are also reviewing the legal changes made by the European Court of Justice relating to the case of HK Danmark v Dansk Almennyttigt Boligselskab.

We've just launched an exciting new partnership with Thrive Mental Wellbeing. As part of this collaboration, we will support employers to manage positive change in mental health and wellbeing at work.

New Case Law 
A reminder of the legal test of harassment on the grounds of sex
This case is a useful reminder of the wide definition of sexual harassment. Sexual harassment can occur without the behaviour being of a sexual nature.

Settlement Agreements can settle future unknown claims under the Equality Act 2010
In an update to a case we reported on previously, the Court of Session in Scotland has upheld an appeal in Bathgate v Technip Singapore PTE Ltd. This case focused on the use of a settlement agreement and whether they could settle future claims.

Review direct sex and maternity discrimination
When the Claimant went on maternity leave, her duties were divided up between existing employees. On her return she was made redundant.

Police Officer is awarded over £800,000 for sexual harassment
This case is a reminder that in discrimination cases, awards for loss of earnings have no limit and can often be much higher than the compensation for injury to feelings.

Dismissing a whistleblower where the decision-maker was unaware of protected disclosure
The Claimant was made redundant by her line manager at the start of the Coronavirus pandemic in 2020. She did not have 2 years of service with the Respondent, so she did not have ordinary unfair dismissal rights.

The Equality Act 2010 (Amendment) Regulation 2023 has updated guidance to align with a new ruling...here's the latest.

Should job applicants have protection against whistleblowing
The Employment Appeal Tribunal recently looked at whether job applicants should have protection against whistleblowing.

Extension to protection from redundancy for pregnant women and those who have taken family leave
The extension of the protected period will apply to any maternity and adoption leave ending on, or after, 6 April 2024 and any shared parental leave starting on or after 6 April 2024.

All employees to have the right to one week of unpaid carer’s leave per year from April 2024
From April 2024, this will change. The Carer's Leave Regulations 2024 will allow employees to apply for one week of unpaid carer's leave within a 12 month period.
