Overview

This practical and participative mock employment tribunal gets managers working together and involved in evaluating the risks and strengths of the case – walking in the shoes of the parties to the case: that’s those of the organisation defending the case, the claimant who has brought it – and even the employment judge tasked with applying the law to the facts as they appear on the day. By seeing other parties’ perspectives, managers can learn how their actions and their intentions may not always completely align!

Vista’s employment lawyers and trained trainers will give your managers a ‘real world’ experience of being involved in an employment tribunal. Our training experience means we design and deliver a mock employment tribunal as a learning experience – not just an observation exercise of lawyers ‘doing their thing’.

Managers will be able to question, challenge and debate the strengths of the case – and if they’re that way inclined, even put themselves forward as witnesses to be cross examined!

Introduction to case and the procedure on the day of a hearingIn plenary:
The delegates are introduced to the case to be ‘heard’ today.

The layout of the tribunal room is explained.

The way the case will be heard is also explained, together with the role of the advocates.
Preparing for the hearing:

Managers will prepare for the hearing, deciding the approach to take in the case and therefore how the witnesses should be cross examined by their Vista team advocate
Delegates divide into their groups.

Trainer-facilitated discussion on the legal framework relevant to the issues.

The teams decides how to approach the case from their particular perspective.
The hearing commences.

Delegates will see the witnesses cross-examined in line with the plan they have devised.
Group returns to plenary:

• Statements are taken as read
• Cross examination of witnesses
• Closing submissions
• Facilitated discussion by Employment Judge on the relative merits of the case.
